Quantifying Extensions of Time under Construction Contracts - Lessons from International Practice and the SCL Delay and Disruption Protocol
Event Description
Extensions of time are a recurring and important issue in construction contracts. Once the contractor’s entitlement to an extension of time has been established, it can be particularly difficult for the parties to anticipate how a court or tribunal will determine the extent of the extension. What weight will be given to the employer’s arguments concerning concurrent delay? What is the scope of the contractor’s duty to mitigate delay? What evidence should the contractor preserve during the works? What is the role and relevance of expert evidence?
International practice has developed a range of concepts, frameworks and methodologies for analysing and quantifying claims for extensions of time. In the United Kingdom, the Society of Construction Law’s Delay and Disruption Protocol provides practical guidance on the analysis and management of delay issues. Should a similar document be developed in Sweden?
The seminar will begin with an overview of the Swedish legal position from both academic and practical perspectives. Dr Aleksander Godhe of King’s College London will then share his experience and insights from an English law perspective, reflecting on the strengths and limitations of the Delay and Disruption Protocol. The seminar will conclude with an open discussion, including questions from the audience.
The seminar will be held in English.
We warmly welcome you to what promises to be a stimulating seminar!
